Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy (“Health Privacy Policy”) supplements The Detox Market (“Detox Market”, “we”, “our” or “us”) Privacy Policy (the “Privacy Policy”) and describes how we collect, use, share and otherwise process consumer health data (as defined below). We are providing this policy to inform you about our privacy practices and your rights concerning your consumer health data. This Health Privacy Policy is limited to residents of Washington and Nevada, and does not apply to employees, job applicants, or business contact data.      

What is Consumer Health Data? 

Generally, consumer health data (“Health Data”) is defined as personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. Note that Health Data does not include publicly available or de-identified data.      

Why We Collect of Your Health Data?

Your Health Data will be collected in connection with your relationship with Detox Market, when you: 1) participate in our skin quizzes; 2) purchase or request a beauty service, in-store digital experience, or product recommendations, if you choose provide such information; and 3) report an adverse event and/or adverse reaction to products you purchase from us. 

What Categories of Health Data Do We Collect?

Generally, we collect Health Data from you when you contact or provide us with data concerning your use of our products and services.  This Health Data may include: 

  • Individual health conditions, treatments, diseases, diagnosis, or diagnostic testing, including your skin condition.    
  • Health-related surgeries or procedures;
  • Use of purchase of prescribed medication
  • Allergy information
  • Bodily functions, vital signs, symptoms, or measurements of health information. 
  • Lab testing and results
  • Health-related data that have been derived or inferred from the above

How We Collect Health Data? 

We collect your Health Data:

  • Directly from you.  We collect Health Data directly from you in order for us to provide you with the products and services that you may request from time to time. For example, when you participate in our skin quizzes you may provide us with information about your skin conditions so that we may recommend products to you.
  • From our Service Providers.  We work with service providers who collect information on our behalf to provide services to us or to you on our behalf. These service providers may collect information, which may include Health Data, to administer our skin quizzes or assist with providing the products and services you request from us.

How We Use Your Health Data? 

Generally, we collect and use your Health Data to facilitate your use of the products and services that you requested or as permitted by applicable law.   

  • Products and Services. We collect Health Data to provide you with services and product recommendations, such as our beauty services, in-store digital experience, or product recommendations, if you choose provide such information. We also collect Health Data if you elect to participate in our skin quizzes. We may use this information to respond to your inquiries and other communications, and analyze and create aggregated, de-identified or anonymized data.
  • Business transfers.  In the event of a merger, dissolution or similar corporate event, or the sale of all or substantially all of our assets, we expect that the Health Data we have collected, would be transferred to the surviving entity in a merger or the acquiring entity. All such transfers shall be subject to our commitments with respect to the privacy and confidentiality of your Health Data as set forth in this Health Privacy Policy.
  • Disclosure to Public Authorities. We may be required to disclose the Health Data that we have collected in response to lawful requests by public authorities, including for meeting national security or law enforcement requirements. We may also disclose Health Data to other third parties when compelled to do so by government authorities or as required by law or regulation including, but not limited to, in response to court orders and subpoenas.
  • Regulatory & Reporting Obligations. We collect Health Data to comply with our safety and reporting obligations, including reporting adverse reactions and adverse events to the products you purchase from us.
  • Legal & Contractual Obligations.  We may disclose Health Data as necessary to comply with our legal and contractual obligations; protecting our, your, or other third parties’ safety or rights; detecting, preventing, and responding to security incidents; protecting against malicious, deceptive, fraudulent, or illegal activity; performing audits; investigating or responding to a complaint or compliance issue; and asserting or defending against legal claims.
  • Aggregate Information (De-Identified Data). Sometimes, we and/or our services providers aggregate or de-identify information so that it can no longer identify you, under applicable laws and regulations. We will use and disclose this aggregated or de-identified information for any purpose, unless such use is prohibited by applicable law.
  • We may process your Health Data for other purposes as disclosed to you at the time you provide such information or otherwise with your consent.
  • To respond to inquiries concerning your data privacy rights.

How We Share Your Health Data? 

Generally, we only provide access and use Health Data in order to provide product recommendations, the products and services that you request and to comply with our reporting and compliance obligations. These third parties, include:

  • Our Service Providers.  We provide our service providers with access to your Health Data to help us store, manage and transmit Health Data concerning products, services that you request. These services include our  beauty services, in-store digital experience, or product recommendations, if you choose provide such information, and to administer our skin quizzes.
  • Legal and Regulatory Authorities. We share Health Data with legal and regulatory authorities and associated third parties as permitted by law or with your consent.

We do not “sell” your Health Data, and we do not “share” your Health Data with any third parties. 

Your Consumer Health Privacy Rights

You may exercise your privacy rights, including the right to withdraw consent, obtain access to and request changes to or the deletion of your Health Data by:

We reserve the right to modify this Health Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.
